Appeals: Why They Happen And What You Need To Do

An appeal is the process in which a case goes to a higher court to be reviewed before a new judge for any mistakes made in the original trial. For example, if your case was before a judge in Winston-Salem, on appeal it goes to the North Carolina court of appeals, then the North Carolina Supreme Court and then to a federal appeals court. Some common reasons for needing an appeal are:

  • Your lawyer made a mistake in arguing your case.
  • You took a plea deal that was detrimental to you
  • The evidence against you was questionable

There are definitely other reasons, but whatever the reason for your appeal it is very important to understand that there is a time limit:

  • You must file your appeal within 14 days of your conviction.
